Hawaii employee rights

Hawaii Employment Law Research Guide

Hawaii workplace issues may involve the Hawaiʻi Civil Rights Commission, the Department of Labor and Industrial Relations, a federal agency, a contract, or a court. The correct route depends on the conduct and requested remedy.

Important 2026 HCRC filing update

The HCRC publications page states that Act 56 (2026) increased the limitations period for filing an HCRC discrimination complaint to one year, applied prospectively, with an enactment date of May 28, 2026. Because application can depend on when the conduct occurred and whether a prior period had expired, confirm the deadline directly with HCRC before relying on it.

Build separate discrimination and retaliation timelines

Record the underlying treatment, protected characteristic or request, complaint date, recipients, decision-maker knowledge, later action, employer explanation, and comparator evidence. Keep the original complaint and all HCRC or EEOC intake confirmations.

Hawaii wage file

  • Paystubs and workweeks at issue.
  • Actual hours, time edits, unpaid tasks, and people who knew.
  • Rate, overtime, tips, deductions, commissions, PTO, or final-pay item in dispute.
  • Employer policy or compensation plan.
  • DLIR contact, complaint copy, confirmation, and response dates.

Verify the route before waiting

Hawaii and federal agencies do not necessarily cover the same employers, claims, remedies, or time periods. Ask whether filings are shared, whether a separate claim is needed, and which event starts each deadline.
