USERRA's reemployment framework
The U.S. Department of Labor states that reemployment rights generally depend on advance notice, no more than five years of cumulative service with that employer subject to exceptions, timely return or application for reemployment, and no disqualifying discharge. Exceptions and special circumstances matter, so verify the full rule with DOL VETS.
Return timing depends on length and circumstances
| Service period or circumstance | DOL summary |
|---|---|
| Less than 31 days | Report for the next scheduled work period after safe travel home and an eight-hour rest period, unless impossible or unreasonable. |
| 31 through 180 days | Apply for reemployment no later than 14 days after service, unless impossible or unreasonable through no fault of the employee. |
| 181 days or more | Apply for reemployment no later than 90 days after service. |
| Service-connected injury or illness | The reporting or application period may be extended for hospitalization or convalescence, subject to the statutory rules. |
The return position is not always the old job title
USERRA uses an escalator principle: eligible returning service members are generally restored to the position and benefits they would have attained with continuous employment, or in some circumstances a comparable or nearest appropriate position. Promotions, layoffs, training, qualifications, disability, and changed business conditions can affect the placement analysis.
Keep a service-and-employment file
- Orders, amendments, dates of service, and communications giving notice.
- Pre-service job title, duties, schedule, pay, seniority, benefits, evaluations, and promotion path.
- DD Form 214 or other release documentation when applicable.
- Date and method of return or reemployment application and the employer's response.
- Position, pay, benefits, training, and seniority offered after return.
- Comments or actions suggesting discrimination or retaliation based on service or enforcement activity.
